§ 1. Platform and buyer terms
Rules for the European Banubo trading platform, purchases and domestic and cross-border delivery.
1. Nature of the platform and scope of offers
Banubo is a European trading platform that enables independent sellers to showcase, offer and sell physical and digital products, buyers to purchase them, and independent sellers to advertise services.
2. Operator and contract
Banubo is operated by Wróblewski Multimedia, ul. Ligocka 51, 44-105 Gliwice, Polska, NIP/VAT UE PL6311794620. Banubo is the seller only where an offer names Wróblewski Multimedia as seller. Otherwise the named independent trader is the seller and Banubo operates the platform and facilitates payments. These terms apply to banubo.eu and applications operating in that domain.
3. European platform scope and delivery availability
Banubo is a European trading platform, whose activities are not limited to Poland. The current shipping-origin and destination configuration area covers Austria, Poland, Germany, Czechia, Slovakia, Hungary, France, Belgium, the Netherlands, Spain, Portugal, Italy, Denmark, Norway, Sweden and the United Kingdom. It covers domestic and cross-border delivery between supported countries; it does not constitute an undertaking to deliver to every European country.
Sellers specify destination countries and available carriers for their offers from the options provided for the shipping origin. Delivery to a particular address depends on the terms of the individual offer presented before ordering. Including a country or carrier in the platform catalog does not guarantee service for every product, address, postcode or service type. Dependent territories and areas with special customs or tax status are not automatically covered merely because of their connection to a listed country.
4. Orders
Buyer registration is public and free. This release permits purchases of physical goods, digital products and files made available electronically, according to the specific offer. Physical goods are delivered only within Europe, to an address or a locker/collection point as specified in the offer. Before payment we identify the seller, product, total price and tax, applicable delivery or digital-delivery terms, withdrawal rights and the payment obligation. Payments are processed by Stripe.
Instant and made-to-order digital products are available worldwide where payment and tax services support the transaction. Physical deliveries follow the 16-country scope above and seller/offer settings. Sellers enter net prices; buyers see tax-inclusive totals before payment. Stripe Tax uses seller registrations and product categories; sellers remain responsible for filing and remittance. Platform subscription and commission taxes are separate.
Offer prices may be provided in EUR, PLN, CZK, HUF, GBP, DKK, NOK, SEK, depending on the prices supplied by the seller. The buyer sees the payment currency and total before placing the order. The interface currency does not guarantee that every currency is available for every offer.
Provide accurate account details, protect your password and do not share your account. Accounts may be temporarily restricted for security, reports of abuse or legal requirements. Attempts to change the country, type of supply or fulfilment method outside the interface are rejected.
5. Price currency and indicative conversion
The offer price is displayed in the currency specified by the Seller for that offer (the “Offer Currency”).
If the currency selected by the Buyer for displaying indicative values differs from the Offer Currency, the Platform also displays an estimated equivalent of the price in the Buyer’s selected currency, provided that a current exchange rate is available. This amount is identified as indicative and is intended to facilitate price comparison.
The indicative conversion does not change the price or the Offer Currency, does not assure the availability of payment in the Buyer’s selected currency and does not guarantee the exchange rate applied when the payment is settled. The amount debited from the Buyer’s account may differ from the displayed equivalent because of the exchange rate and charges applied by the Buyer’s payment service provider.
Before placing an order entailing an obligation to pay, the Buyer is clearly shown the payment currency and the total amount payable to the Seller, including taxes and applicable delivery costs. Selecting a currency for indicative price display does not constitute consent to a currency conversion service. If such a service is offered, disclosure of its terms, exchange rate and charges, and the Buyer’s consent, are subject to applicable law.
6. Appreciations and ratings
An appreciation is a voluntary positive signal from a verified buyer, available after confirmed fulfilment of a purchase. The buyer may withdraw it, and the counter includes active appreciations only. Appreciations do not change the product or seller star-rating average. They may contribute to a social-proof signal used together with other parameters in offer ranking, without guaranteeing any particular position.
A product rating for an individual order item is the arithmetic mean of the Quality and Matches the description criteria. A seller rating for an individual transaction is the arithmetic mean of the Packaging, Delivery time and Customer service criteria.
The public product rating is the arithmetic mean of published ratings for that product, and the public seller rating is the arithmetic mean of published ratings for that seller’s transactions. Every eligible rating has equal weight regardless of order value. Ratings hidden or excluded through moderation are not included. Earlier published ratings created before criterion-based ratings remain included using their stored value.
7. Rights and contact
Banubo services are governed by Polish law subject to mandatory provisions. A choice of law does not deprive consumers of protections that cannot be derogated from by agreement, including those of their country of habitual residence where applicable. The law governing a contract with an independent seller and court jurisdiction are determined under applicable rules; these Terms do not impose exclusive Polish jurisdiction on consumers. Consumers may use applicable out-of-court dispute-resolution procedures. The EU ODR platform has closed and is not presented as a complaints channel.
Mandatory consumer rights are not limited. The seller is responsible for conformity, fiscal documents, delivery, complaints and returns; Banubo is responsible for its platform service. Illegal content may be reported under the Moderation and DSA policy. Contact: [email protected]. You must not publish unlawful, misleading or rights-infringing content.
§ 2. Seller and P2B terms
Professional-selling terms, delivery configuration and seller responsibilities.
1. YouTube videos in offers
Sellers and Advertisers may include videos from their own YouTube channels in offers using the available embedding feature to demonstrate their creations and encourage purchases. The publisher must hold the rights and permissions needed for this use, including music, likenesses and other protected material, and enable embedding on YouTube. Videos must comply with the law, these terms and moderation rules, accurately represent the offer and not mislead. They supplement the description and do not replace mandatory information, warnings or purchase conditions. Playback depends on video availability, channel settings and YouTube’s terms; Banubo does not guarantee uninterrupted availability.
2. Access and identity
Seller registration is publicly available. Selling requires the verification and activation conditions applicable to the seller and offer to be met; creating an account alone does not authorise publication or payouts. Traders and eligible natural persons conducting unregistered activity may sell. One legal seller may operate multiple shops and invite staff. Banubo does not support occasional private or P2P selling. The seller must provide and update the required identity, contact, registration or personal, tax, DAC7 and Stripe Connect data according to their status and use of services. Own InPost account details are required only when using a model that requires such an account. Accounts and contracts belonging to another legal seller must not be used.
An unregistered-activity seller must be at least 18 years old, be an eligible natural person, monitor the statutory revenue limit and register in CEIDG when required. From 2026 the Polish limit is quarterly: 225% of minimum wage, equal to PLN 10,813.50 gross per quarter in 2026; after exceeding it, the CEIDG filing must be made within 7 days.
3. Arranging domestic and cross-border delivery
The seller configures the shipping origin, destination countries and carriers available in their offers, taking account of actual transport capability and product and address restrictions. Before the contract is concluded, the seller discloses the delivery area, method, price and expected time. Destination restrictions must not constitute unlawful discrimination based on nationality or residence; this does not require sellers to arrange delivery to countries they do not serve.
The seller independently sets delivery prices using carriers’ current commercial offers or individually negotiated agreements. Carrier tariffs do not automatically determine the amount payable by the buyer; the delivery price disclosed and agreed at purchase is binding. The seller may offer free delivery. A later tariff change, carrier surcharge or configuration change does not permit a unilateral price increase for an existing contract.
The seller independently contracts and settles with the carrier, dispatches the parcel, provides suitable packaging and required documents, and communicates available dispatch and tracking information to the buyer. The seller fulfils product, tax, export and import obligations to the extent required by their role and applicable law, including destination-country requirements. This does not displace statutory obligations of Banubo or other transaction participants. Polish unregistered-business rules concern that status under Polish law; they do not replace registration and tax requirements applicable to business in another country.
4. Duties and ranking
The seller is responsible for lawful and safe products, files and services, accurate prices and descriptions, taxes, sales records, fulfilment, withdrawals, complaints, refunds and recalls. Unregistered activity requires sales records, documents on request and annual PIT-36 reporting. It generally may use the Polish VAT exemption up to PLN 240,000 annual sales in 2026, subject to statutory exclusions. It does not remove tax, consumer, product-safety, sales-documentation or regulated-activity obligations, and the seller must update Banubo if their status changes. Compliant physical goods, digital products and files may be published when they meet Banubo technical, licensing and safety requirements. Ranking primarily uses relevance, availability, offer completeness, service quality, freshness and clearly labelled paid promotion.
Physical products must satisfy GPSR and publication completeness requirements; digital products and files must meet technical, licensing and safety requirements. Moderation does not transfer responsibility for a product, file or licence to Banubo. Payment for promotion does not guarantee sales. Sellers can access their own detailed order data; aggregated platform data may be commercially confidential.
5. AI-assisted tools
Banubo may provide sellers with optional tools supported by artificial-intelligence systems in the offer editor. These tools may, in particular, suggest an offer description, category and metadata from information provided by the seller.
The results of these tools are for assistance and illustration only; they do not guarantee that proposed content or categories are accurate, complete or lawful.
Before saving or publishing an offer, the seller must review and, where necessary, correct every AI-generated suggestion. In particular, the seller must ensure that the final offer content, chosen category and metadata match the product’s actual characteristics and comply with law, these terms and third-party rights.
As at the effective date of these terms, AI tools are available without a separate charge, within the current limits displayed in the offer editor. Banubo may later introduce paid access to AI tools, paid limit increases or other paid AI features. Before a payment obligation arises, Banubo will provide the seller with the service scope, applicable limits, price and billing terms, and obtain any required confirmation.
To the extent permitted by mandatory law, Banubo does not guarantee that AI-generated results are error-free, current or fit for a particular purpose. The seller remains ultimately responsible for offer content, category and metadata accuracy, and the publication’s compliance with law.
6. Restriction and complaints
Banubo provides reasons and appeal routes for restrictions. Urgent legal or safety cases may be acted on immediately; other termination normally receives at least 30 days’ notice, subject to statutory exceptions.
Complaints and appeals may be sent to [email protected]. Changes to terms governed by P2B are notified to sellers on a durable medium at least 15 days in advance, with a proportionately longer period where technical or commercial adaptations are required. Exceptions apply only as permitted by law, in particular a legal obligation preventing compliance with that period or an unforeseen and imminent danger. The absence of a need for technical adaptations does not itself remove the notice obligation. Purely editorial changes that do not alter the content or meaning of the terms are not changes to terms in this sense.
§ 3. Seller fee schedule
Seller platform fees, distinct from delivery prices and carrier settlement.
1. Rates
Kram: subscription 0.00 PLN / month; shop limit: 1; item limit per shop: 25; commission: 8% + 1.50 PLN operating fee per order.
Pracownia: subscription 49.00 PLN / month; shop limit: 1; item limit per shop: 200; commission: 7% + 1.50 PLN operating fee per order.
Manufaktura: subscription 149.00 PLN / month; shop limit: 3; item limit per shop: 1000; commission: 6% + 1.50 PLN operating fee per order.
Gildia: subscription 349.00 PLN / month; shop limit: 10; item limit per shop: 5000; commission: 5% + 1.50 PLN operating fee per order.
The percentage applies to the gross product value only, excluding delivery, and the fixed amount applies once per order.
All listed amounts are net. For domestic platform services Banubo adds 23% VAT; the seller VAT status may affect its input-VAT deduction but does not change Banubo VAT charging. Seller views show the net amount, VAT and gross payable fee.
Stripe, carrier, product-tax and optional promotion charges are disclosed separately. Platform fees are reversed proportionally for successfully refunded value, except a cost clearly disclosed as irreversible before it was incurred.
2. Delivery prices and cross-border settlement
The delivery price set by the seller and disclosed to the buyer is separate from Banubo fees and the carrier remuneration settled under the seller’s contract. Using a public tariff or individual agreement does not automatically synchronise tariffs in Banubo. Free delivery does not exempt the seller from platform commission or obligations to the carrier. Commission calculations, including excluding delivery from the percentage calculation basis, remain unchanged. Tax treatment of cross-border platform services follows the applicable place-of-supply rules and the recipient’s status; the domestic VAT-rate description does not apply that rate to every foreign transaction.
3. Invoices
Banubo issues accounting documents for its own services as required by applicable law. Sellers remain responsible for buyer sales documents unless a separate self-billing agreement exists.
§ 4. Delivery, withdrawal, complaints and refunds
Domestic and international delivery, withdrawal, complaints and return costs.
1. Delivery
Physical goods are delivered only within Europe. The seller chooses carriers from the options available for the shipping origin and selected destinations, including InPost, DHL, DPD or FedEx as applicable. The seller specifies the available delivery methods and the operator or carrier in the offer. Before placing an order, the buyer receives information about the delivery method, its cost and the expected delivery time, and chooses from the methods available for that offer. The seller is responsible for proper dispatch and packaging and provides a tracking number where the selected service includes one. Where a consumer uses a delivery method offered by the seller, the seller bears the risk of accidental loss of or damage to the goods until they are delivered to the consumer. Consumer rights against the seller do not depend on first submitting a complaint to the carrier or on the outcome of that complaint. Changes to these terms do not alter delivery conditions agreed for contracts already concluded. Digital products and files are made available electronically according to the offer and do not require physical delivery. Digital files may be supplied in a password-free, unencrypted ZIP archive or directly in 3MF or STL format; Banubo may inspect the contents and security characteristics of supplied files to reduce fraud and improve buyer and seller satisfaction.
2. Cross-border customs and tax formalities
The European delivery area is not a single customs or tax territory. In particular, deliveries to or from Norway and the United Kingdom may involve customs formalities, import tax, customs duty or clearance fees. Norway’s membership of the European Economic Area does not make it part of the EU customs or VAT territory. The rules applicable to Northern Ireland and other territories with special status must be observed.
Before the contract is concluded, the seller discloses known delivery costs, taxes and other charges payable by the buyer. Where specific charges cannot reasonably be calculated in advance, the seller explains that they may arise and how they are determined. Responsibility for clearance and individual charges follows applicable law and the disclosed transaction terms; it is not presumed always to rest with the buyer. A general warning about possible charges does not replace disclosure of costs known to the seller or permit costs to be shifted to consumers contrary to law.
3. Delivery time and delay
The seller delivers within the time agreed at purchase. Where applicable law requires delivery without undue delay and no later than 30 days after contract conclusion unless otherwise agreed, that rule applies. Carrier or customs delays do not remove statutory consumer remedies, including setting an additional delivery period and ending the contract in the cases provided by law. The seller communicates obstacles and the expected progress of fulfilment.
4. Cross-border returns and complaints
Cross-border delivery does not remove withdrawal rights or remedies for goods that do not conform to the contract. The seller provides a return address and information needed to return the goods correctly. On withdrawal, consumers bear direct return costs only if properly informed before purchase; where goods cannot normally be returned by post, the legally required cost information also applies. Free delivery at purchase does not automatically mean a free return following withdrawal.
The seller bears the costs of bringing goods into conformity, including necessary transport for a justified complaint, to the extent required by applicable law. These must not be confused with return costs following withdrawal without giving a reason. Any refund of customs duty or import tax follows the applicable procedure and is not automatically guaranteed by Banubo. Choosing a carrier from options offered by the seller does not transfer transport risk to the consumer before delivery of the goods.
5. Withdrawal
A consumer generally has 14 days from receipt of goods, or from contract conclusion for services and digital content, to withdraw from a distance contract. Loss of the withdrawal right for paid digital content supplied without a tangible medium requires all of the following: supply beginning with the consumer’s prior express consent before the withdrawal period expires; information about the loss of the right and acknowledgement of that information; and confirmation of the contract and the consent received supplied on a durable medium. Payment or making a file available alone is insufficient. If these conditions are not met, the consumer retains the withdrawal right. A failed payment does not complete the purchase or release the file. Statutory remedies for digital content that is not in conformity with the contract remain unaffected.
Send the withdrawal notice to the seller through Banubo or its disclosed contact address, including when the account return form is unavailable. The availability of a return button and the seller’s absence from a business register do not determine statutory consumer rights. Return goods within 14 days of withdrawal unless the seller has offered collection. The consumer bears direct return costs only if informed before purchase. The seller refunds the payments due within 14 days of receiving the notice, including the cost of the least expensive standard delivery offered at purchase. For goods, the seller may withhold reimbursement until receipt of the goods or evidence of dispatch, whichever occurs first. Use the original payment method unless the consumer expressly agrees to another method without additional costs.
6. Complaints and model form
The named seller is responsible for conformity and statutory remedies for goods, digital products, files and services. Model notice: “To [seller shown in the order], I withdraw from order [number] for [product, file or service], received or concluded [date]. Name, address, date.” A signature is needed only on paper. Refunds include the least expensive standard delivery where required and are made within the statutory period.
§ 5. Prohibited products
Goods that may not be listed.
1. Prohibition
Illegal, stolen, counterfeit, unsafe or recalled goods are prohibited, including weapons, ammunition and explosives, narcotics, unlawfully supplied medicines or medical devices, live animals, child sexual abuse material, and goods infringing sanctions, intellectual property or protected-species rules. Banubo may stop publication, preserve evidence and report the matter to competent authorities where an offer violates prohibitions or safety requirements.
§ 6. Moderation, notices and DSA
Illegal-content notices, reasons and appeals.
1. Notice and decision
A notice should identify the exact content, explain why it is illegal, include contact details unless protected anonymity applies, and confirm good faith. Use the listing report feature or [email protected]. We assess notices diligently and provide affected users with the restriction, facts, legal or contractual ground, automation used and appeal options unless law prevents notice.
2. Appeal and misuse
Appeals can be submitted through the account or contact address and are reviewed by someone able to reverse the decision. After warning, repeated manifestly unfounded notices or manifestly illegal content may lead to temporary suspension.
§ 7. GPSR product safety and recalls
Traceability, warnings and recall handling.
1. Safety and conformity of physical creations
The Seller may offer only products complying with the law applicable to the product and the market targeted by the offer, including applicable European safety and conformity requirements. According to their role, the Seller provides required manufacturer and responsible-person details, product identification, markings, instructions and warnings in the required language, and mandatory information in the online offer. CE marking and specific standards apply where required by the rules governing that product. An original or handmade character does not exempt a product from applicable requirements. Banubo does not provide a blanket guarantee that all offers are certified; these provisions do not exclude Banubo’s own statutory duties.
2. Before listing
Physical listings require a product identifier, manufacturer postal and electronic contact, applicable warnings and traceability, and an EU responsible person where required. Sellers retain supporting compliance documents.
3. Incident and recall
Sellers must promptly report accidents, risks, corrective actions and recalls. Banubo hides affected offers, identifies purchasers, sends safety notices and cooperates with authorities and Safety Gate. A recalled offer cannot return without documented remediation and moderation approval.
§ 8. Accessibility information
Accessible purchasing and barrier reporting.
1. Support
Banubo aims to make registration, search, cart, payment, orders and legal information operable by keyboard and assistive technology, with visible focus, accessible names and understandable errors. Report a barrier to [email protected] with the page, problem, assistive technology and desired contact method; we will provide accessible information without undue delay.
§ 9. DAC7 seller notice
Seller tax-data verification and DPI/DAC7 reporting.
1. Data and reporting
We collect and verify a seller’s legal name, main address, registration number, TIN and issuing country, VAT number, relevant sole-trader birth date, payout-account identifiers and account-holder data where required. We also collect the country of registration and account-holder data where required. Transaction data is aggregated quarterly for annual DAC7 reporting. Banubo is responsible for determining reporting scope, verification and providing required information to the Polish KAS and the seller within the statutory deadline. Generating a data package in the system does not constitute filing a report; the package requires review and submission through the appropriate procedure. Reporting exclusions are not tax exemptions.
2. Missing data
Incomplete or unreliable DAC7 data blocks publication and payouts. After two reminders and 60 days from the first request, Banubo may close the account or withhold payment as permitted by law. Records are retained for the statutory period.
§ 10. Shipping and prepaid terms
Seller-arranged delivery, regional carriers and conditionally available integrated services.
1. Shipping models
Integrated InPost services and prepaid top-ups are available only when enabled and offered in the Banubo interface. These terms alone do not activate those services; where unavailable, the seller may use seller-arranged delivery as specified in the offer.
A seller chooses platform InPost, their own InPost account, or seller-arranged delivery. Platform InPost enables lockers and courier after the first successful top-up. A verified own account enables lockers. Seller-arranged delivery is available regardless of the chosen model and does not require Banubo to integrate with that operator or carrier. The seller fulfils delivery on the terms selected by the buyer when ordering.
2. Seller-arranged delivery and regional carriers
In the seller-arranged delivery model, the seller selects the countries and courier companies available in their offers and sets delivery prices under the Seller Terms. Banubo provides tools to configure and display these terms; it does not book these shipments, buy labels or track shipments automatically. Selecting a carrier does not conclude a carriage contract or confirm access to a tariff or commercial terms.
Depending on the country and available service, choices may include international carriers such as DHL, UPS and FedEx and domestic or regional operators, for example InPost and DPD in Poland, Packeta in Czechia and Slovakia, Österreichische Post in Austria, PostNord in Denmark, Norway and Sweden, PostNL in the Netherlands, bpost in Belgium, Colissimo in France, Correos in Spain, CTT in Portugal and Poste Italiane in Italy. These examples are neither an exhaustive list nor a guarantee of every route or address; available choices depend on the origin, selected destinations and platform options.
Carrier conditions govern the transport service within the limits of the law. They do not replace the agreed sale terms or restrict mandatory consumer rights. Banubo remains responsible for its own services and statutory duties; seller-arranged carriage does not exclude that responsibility. Integration and prepaid provisions apply only once the relevant service is actually enabled and do not cover carriage contracts settled independently by the seller.
3. Prepaid and tariff
The provisions on prepaid funds, the wallet, label purchases using wallet funds and automatic surcharges apply only to InPost shipments billed under the platform model; they do not apply to seller-arranged shipping through other operators or shipments billed to the seller’s own InPost account. Prepaid is purchased through Stripe in PLN 25, 50 or 100 amounts. Funds are assigned to the seller, may be used only for platform shipping, and are non-refundable except where mandatory law requires otherwise. Buyer-facing prices and wallet charges follow the current InPost tariff available in Banubo.
4. Parcel size and surcharges
The seller is responsible for correct parcel size, weight and packaging. For platform InPost shipments, Banubo compares the dispatched size with the offer. A more expensive size is charged automatically as a separately visible surcharge. The wallet cannot become negative; insufficient funds block label purchase until the wallet is topped up.
5. Complaints
Wallet or fee complaints may be sent to [email protected]. Carrier complaints follow the applicable terms of the operator or carrier handling that shipment and applicable law. These terms do not restrict rights that cannot be excluded by contract.
